These Terms & Conditions apply to bookings made with Sixstar Bespoke Tours Ltd (“Sixstar”, “we”, “us” or “our”).

Please read them carefully before confirming your booking.

By signing our Booking Agreement and subsequently making payment, you confirm that you have read, understood and accepted these Terms & Conditions.

1. YOUR BOOKING

All tours provided by Sixstar Bespoke Tours Ltd are private tours unless otherwise stated.

A booking is not confirmed until:

  • the itinerary, dates and agreed price have been confirmed;
  • the lead guest has accepted our Terms & Conditions and returned the Booking Agreement; and
  • the required booking deposit has been received.

Once these steps have been completed, your booking is confirmed and the agreed tour date(s) will be reserved exclusively for your party.

The person making the booking is considered the lead guest and is responsible for ensuring that all members of their party are aware of the booking arrangements and these Terms & Conditions.

2. BOOKING DEPOSIT

A deposit is required to secure your tour dates. The amount required will be stated clearly on your quotation and invoice.

Your tour dates are not reserved until the required deposit has been received.

Once your booking is confirmed, Sixstar reserves the agreed vehicle, driver/guide and tour date(s) for your party and may decline other bookings for those dates.

If you later cancel your booking, cancellation charges may therefore apply as set out in Section 6.

Any amount retained following cancellation will be subject to applicable consumer law and will reflect losses and costs reasonably incurred by Sixstar as a result of the cancellation, taking account, where appropriate, of costs saved and our ability to obtain replacement work.

3. BALANCE PAYMENT

The remaining balance and its due date will be shown on your booking confirmation or invoice.

The balance must be paid by the stated due date unless alternative arrangements have been agreed by us in writing.

If payment is not received when due, we will contact you before taking further action. If payment remains outstanding, we may treat the booking as cancelled by the customer and the cancellation provisions below may apply.

4. TOUR PRICE

Your agreed tour price covers only the services specifically stated in your quotation, itinerary or booking confirmation.

Unless specifically stated otherwise, entrance fees, attraction tickets, meals, refreshments, guest accommodation and personal expenses are not included.

Where a tour requires the driver/guide to stay away from our Edinburgh base, any agreed contribution towards the driver’s accommodation will be clearly stated in your quotation before booking.

Any material change requested by the customer after confirmation may result in an additional charge. We will explain and agree any additional charge with you before the change is confirmed.

5. CHANGES REQUESTED BY CUSTOMER

We understand that travel plans can change and we will always try to accommodate reasonable requests.

Changes to dates, hotel/accommodation collection location, destinations or the agreed itinerary are subject to availability and may affect the price.

No material change is confirmed until agreed by Sixstar in writing.

Changes requested during the tour are at the discretion of the driver/guide and will depend on available time, driving hours, road conditions, attraction opening times and safety considerations.

6. CANCELLATION BY CUSTOMER

All cancellations must be made in writing by email.

The effective cancellation date is the date on which we receive your written cancellation.

Because our tours are private and the vehicle and driver/guide are reserved specifically for your party, cancellation may result in Sixstar losing other bookings for the same dates.

Where a customer cancels, Sixstar may retain or charge an amount that reasonably reflects the losses directly resulting from the cancellation, subject to applicable consumer law.

When determining this amount, we may take into account costs already incurred, commitments made specifically for the booking, the loss arising from reserving the vehicle and driver/guide for your dates, and whether we have been able reasonably to reduce our loss by obtaining replacement work.

If we are able to resell the cancelled dates or otherwise reduce our loss, this will be taken into account when calculating the cancellation charge.

Where a cancellation charge applies, we will provide an explanation of the amount if requested.

Any third-party costs that we have paid on your behalf and which cannot be recovered may also be deducted from any refund, where legally permitted.

We strongly recommend that all guests obtain appropriate travel insurance covering cancellation, illness, travel disruption and other circumstances that could prevent them from taking their tour.

7. CANCELLATION OR SIGNIFICANT CHANGES BY SIXSTAR

In the unlikely event that Sixstar has to cancel your tour because we are unable to provide the agreed service, we will inform you as soon as reasonably possible.

Where appropriate, we may offer a reasonable alternative arrangement.

If we cancel and cannot provide an agreed suitable alternative, payments made to Sixstar for the affected service will be refunded as required by applicable law.

We are not responsible for losses arising from circumstances outside our reasonable control except where the law provides otherwise.

Nothing in these Terms & Conditions affects your statutory rights.

8. WEATHER, ROAD CONDITIONS AND EVENTS OUTSIDE OUR CONTROL

Scotland’s weather and road conditions can change quickly.

For safety or operational reasons, it may occasionally be necessary to alter the route, timings or order of stops.

Circumstances outside our reasonable control may include severe weather, road closures, accidents, ferry cancellations, attraction closures, strikes or other transport disruption.

Where this happens, your driver/guide will make reasonable efforts to provide a suitable alternative while keeping the character of the booked tour wherever possible.

Safety will always take priority.

9. FERRIES, ATTRACTIONS AND THIRD PARTY SERVICES

Where ferry travel forms part of the agreed itinerary, Sixstar Bespoke Tours Ltd will normally arrange the required ferry booking on behalf of the customer.

Ferry services are operated by independent third-party providers and are subject to their own schedules, availability, operational requirements and cancellation policies.

Ferry services may be delayed, amended or cancelled due to weather, operational issues or other circumstances outside Sixstar’s reasonable control. Where this occurs, we will make reasonable efforts to adjust the itinerary or provide a suitable alternative route where possible.

Attraction tickets, boat trips, trains and other third-party activities are not included or booked by Sixstar unless specifically agreed in advance.

Where guests are required to book their own attraction or activity tickets, we will advise them of suitable timings where possible.

10. HOTEL/ACCOMMODATION COLLECTION TIMES AND DELAYS

Guests will normally be collected from their hotel or accommodation at the agreed collection time, unless an alternative arrangement has been agreed with Sixstar Bespoke Tours Ltd in advance.

Guests should be ready for collection at the agreed time. If you expect to be delayed, please contact us as soon as possible.

Significant delays caused by guests may require the day’s itinerary to be shortened or adjusted and do not automatically entitle guests to additional touring time.

If a tour runs beyond the agreed duration at the customer’s request, and the driver/guide is able to accommodate the additional time, an additional charge may apply. Any applicable overtime charge will be communicated and agreed with the customer.

11. GUEST CONDUCT AND VEHICLE HIRE

We want everyone to enjoy their tour safely and comfortably.

Guests are expected to treat the driver/guide, vehicle, accommodation providers, attractions and members of the public with reasonable respect.

Smoking and vaping are not permitted inside our vehicles.

Guests may be responsible for the reasonable cost of repairing damage or specialist cleaning required as a direct result of damage or excessive soiling caused by them, where permitted by law. This may include significant food or drink spillages.

We reserve the right to end or refuse to continue a tour where a guest’s behaviour presents a genuine safety risk, involves unlawful conduct, or amounts to serious abusive or threatening behaviour.

12. CHILDREN AND CHILD SEATS

Children are welcome on our private tours.

Child seats can be provided by prior arrangement. Parents or guardians must tell us in advance the ages of children travelling and any relevant seating requirements so that appropriate arrangements can be made.

Children remain the responsibility of their parent or guardian throughout the tour.

13. LUGGAGE AND PERSONAL BELONGINGS

Guests are responsible for ensuring that the amount of luggage they intend to bring is suitable for the vehicle being used.

Please discuss unusually large amounts of luggage or specialist equipment with us before booking.

Guests are responsible for their own personal belongings. Sixstar will take reasonable care but cannot accept responsibility for items lost or left behind except where the loss results from our failure to exercise reasonable care.

Where an item is left in one of our vehicles, we will make reasonable efforts to return it. The customer may be asked to pay reasonable postage, packaging or courier costs before the item is returned.

14. GUEST ACCOMMODATION

Guest accommodation is not included in the tour price unless expressly stated otherwise in writing.

Guests will normally arrange and pay for their own accommodation.

At a customer’s request, Sixstar may, at our discretion, assist with accommodation recommendations or bookings. Any such assistance will be discussed and agreed separately.

Where accommodation is booked directly by the customer, the booking is between the customer and the accommodation provider and is subject to that provider’s own terms and cancellation policy.

Sixstar cannot guarantee the availability, standard or services of independently booked accommodation providers.

This section relates to guest accommodation only. Any agreed contribution towards accommodation required for a Sixstar driver/guide will be stated separately in the customer’s quotation or booking correspondence.

15. TRAVEL INSURANCE

We strongly recommend comprehensive travel insurance for all guests.

Your insurance should provide appropriate cover for cancellation, illness or injury, missed or cancelled transport, disruption, personal belongings and other risks relevant to your trip.

Sixstar is not responsible for losses that would reasonably be covered by appropriate travel insurance unless we are legally responsible for causing the loss.

16. COMPLAINTS

If you experience a problem during your tour, please tell your driver/guide or contact Sixstar as soon as possible so that we have an opportunity to resolve it.

If the matter cannot be resolved during the tour, please contact us in writing after the tour with details of your concern.

We will investigate and respond as soon as reasonably possible.

17. LIABILITY AND YOUR LEGAL RIGHTS

We will provide our services with reasonable care and skill.

Nothing in these Terms & Conditions excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by negligence.

Nothing in these Terms & Conditions removes or limits any statutory rights that you have as a consumer.

18. BOOKING AGREEMENT AND EVIDENCE OF ACCEPTANCE

Before payment of the booking deposit, the lead guest will be required to sign or electronically accept our Booking Agreement confirming that they:

  • have received these Terms & Conditions;
  • have had an opportunity to read them;
  • understand the cancellation provisions;
  • confirm their booking details; and
  • agree to be bound by these Terms & Conditions.

A copy of the customer’s acceptance will be retained with the booking record.

19. GOVERNING LAW

These Terms & Conditions are governed by the applicable laws of Scotland.

Nothing in this section prevents a consumer from relying on any mandatory rights regarding jurisdiction that apply to them under consumer law.
